By using our website or enquiring about, enrolling in or participating in our Services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this Agreement. Use of the website constitutes acceptance of these Terms. If you do not agree, please discontinue use of the website and do not proceed with any enrolment.

Tao Yuen operates a non-medical lifestyle community for older adults in Hong Kong's Mid-Levels. Our services include:

Services are available to individuals residing in or visiting Hong Kong. Tao Yuen is not a medical facility and does not provide clinical or nursing care.

4. Enrolment and Residency

Participation in any Service requires a simple application and, for the Residence Plan, a signed Residency Agreement. Availability is subject to capacity. We reserve the right to decline applications where we reasonably determine that our Services are not suited to the applicant's needs, in which case we will explain our reasons and suggest alternatives where possible.

Website Users are expected to use the site for lawful purposes only and not to attempt to disrupt, damage or gain unauthorised access to any part of it.

6. Intellectual Property

All content on the Tao Yuen website — including text, images, design and programme materials — is the property of Tao Yuen or its content suppliers and is protected under applicable Hong Kong law. You may view and print content for personal, non-commercial use only. No reproduction, distribution or commercial exploitation is permitted without our prior written consent.

7. Payment Terms

All fees are quoted in Hong Kong Dollars (HKD). Monthly fees are due in advance at the beginning of each calendar month. Accepted payment methods will be confirmed at the time of enrolment. Fees are subject to annual review; Residents will be given at least 30 days' notice of any change.

Notice and termination: Either party may terminate a monthly arrangement by giving one calendar month's written notice. Fees paid for the notice period are not refundable unless termination is due to a material breach by Tao Yuen.

Our Services are provided on a reasonable-efforts basis. While we maintain high standards of care, attention and programme quality, we do not make any representation that outcomes — social, cultural or personal — will meet any specific expectation. The website is provided "as is" and without warranty of any kind as to uninterrupted access or freedom from error.

10. Limitation of Liability

To the extent permitted under Hong Kong law, Tao Yuen's liability for any claim arising from its Services or website shall not exceed the fees paid by the relevant individual in the three months prior to the event giving rise to the claim. We are not liable for indirect, consequential or special losses. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.

11. Indemnification

You agree to indemnify Tao Yuen, its staff and associated parties against any claims, losses or expenses arising from your breach of these Terms or your conduct in connection with our Services or website.

12. Termination

Either party may terminate ongoing Services by giving one calendar month's written notice. Tao Yuen may terminate immediately in the event of serious or repeated breach of these Terms or conduct that poses a risk to the safety or wellbeing of other residents or staff. On termination, Residents will be given reasonable time to make alternative arrangements. Certain provisions of these Terms (including Intellectual Property and Limitation of Liability) survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute arising from these Terms or our Services shall first be addressed through informal discussion. If not resolved within 30 days, the parties may refer the matter to mediation before the Hong Kong Mediation Centre, or to the courts of the Hong Kong SAR, which shall have exclusive jurisdiction.

14. General Provisions

These Terms, together with any signed Residency Agreement, constitute the entire agreement between us. If any provision is found unenforceable, the remaining provisions continue in force. Our failure to enforce any provision at any time does not waive our right to do so in the future. We may not assign our rights or obligations without consent; Residents may not assign their residency to another person.

15. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. For Residents, we will provide at least 30 days' notice of material changes. Continued use of our Services after notice constitutes acceptance of the updated Terms.
